FinCEN Files: kako su sumnjive transakcije postale globalna priča

In September 2020, a large international reporting project revealed how banks had filed reports about potentially suspicious transactions with the U.S. Financial Crimes Enforcement Network, known as FinCEN. The documents did not amount to a complete record of global money laundering. They offered something more specific: an unusual view into the warnings that financial institutions sent to authorities while moving funds through the international banking system.

The project became known as the FinCEN Files. It was first reported by BuzzFeed News in cooperation with the International Consortium of Investigative Journalists (ICIJ), together with more than 100 media organisations in countries around the world. The reporting examined thousands of leaked documents and traced transactions across borders, institutions and jurisdictions.

Reports of suspected suspicious activity, commonly called Suspicious Activity Reports or SARs, are confidential filings submitted by financial institutions to FinCEN. Banks and other regulated institutions use them when they identify transactions or patterns that may require the attention of law-enforcement or financial-intelligence authorities.

A SAR is not a criminal charge, a court judgment or a finding that a customer has committed an offence. Filing such a report generally means that a bank has identified circumstances it considers worthy of investigation. The report may describe the people, companies, accounts, jurisdictions and transactions involved, along with the reasons for the institution’s concern.

A suspicious-activity report is an alert for authorities, not proof of criminal conduct. Determining whether a crime occurred requires further investigation and, where relevant, judicial proceedings.

Što je projekt otkrio?

BuzzFeed News and ICIJ reviewed more than 2,100 SARs and related documents covering transactions reported between 1999 and 2017. According to the project’s published findings, the reports described more than 2 trillion U.S. dollars in transactions that banks had treated as potentially suspicious. The figure represented the value of transactions discussed in the documents, not a confirmed amount of illicit money.

The investigation showed how money could move through a chain of financial institutions even after a bank had raised concerns. Documents described payments involving companies, intermediaries and accounts in multiple countries. In many cases, the available records did not establish the final ownership of assets or explain whether the underlying activity was lawful.

One of the central findings was the tension between the role of banks as gatekeepers and the limits of the system in which they operate. Banks are expected to identify and report potential risks, but they may not be able to stop every transaction immediately. FinCEN Files reporting also examined cases in which institutions continued processing payments while reporting concerns to authorities, a practice that can occur under the rules governing suspicious-activity reporting but raises important questions about enforcement and accountability.

The documents concerned the U.S. financial-intelligence system, but the transactions were international. Money moved through correspondent banks and financial centres in different countries, while companies and individuals used legal structures that could span several jurisdictions. A payment recorded in one country could therefore be connected to an account, company or beneficiary elsewhere.

ICIJ coordinated reporting by journalists in dozens of countries so that separate pieces of the same financial chain could be examined together. This approach was important because a single newsroom might see only one payment or one company, while the combined investigation could reveal repeated patterns across borders.

For readers in Croatia and elsewhere in the European Union, the project illustrates why cross-border cooperation matters in financial reporting. International transfers, company ownership and banking records rarely follow the boundaries of one state. At the same time, the existence of an international connection does not by itself indicate illegal conduct. Each case requires verification of the people, documents, dates, legal entities and relevant decisions.

Što FinCEN Files ne dokazuju?

Ipak, pojedini dokumenti mogu sadržavati nepotpune informacije, a činjenica da je banka nešto prijavila ne znači da su nadležna tijela kasnije potvrdila sumnju.

Kako čitati ovakve financijske istrage?

Najvažnije je razlikovati četiri razine informacija: ono što dokument izravno navodi, ono što banka sumnja, ono što su novinari neovisno provjerili i ono što su kasnije utvrdile službene institucije ili sudovi. Te se razine ne smiju spajati u jednu tvrdnju.

Čitatelji bi trebali obratiti pozornost na datume, ulogu svake osobe ili tvrtke, vrstu dokumenta i je li određeni navod potvrđen iz više izvora. Također je važno razlikovati stvarnog vlasnika od direktora, posrednika ili osobe koja se samo pojavljuje u komunikaciji. Slična imena i povezane kompanije mogu dovesti do pogrešne identifikacije.
